Uniquely Tours & Experiences Terms and Conditions

Uniquely Tours & Experiences, LLC, doing business as Uniquely Tours (“Uniquely Tours”, “we”, “us”, “our”), is a limited liability company organized and existing under the laws of the State of Texas offering fun, educational, and engaging tours to help share the story of Houston for tour participants and tourists alike (“you”, “traveler”). 

 

1. Contract 

These terms and conditions including any brochures, documents, correspondence, the terms and conditions of our suppliers, our Privacy Policy, and our Terms of Use (collectively, the “Terms and Conditions”) form the basis of the contract with you. Before making a booking with us you must ensure that you have read and understand these Terms and Conditions (raising any questions you may have with us). By booking with us and in consideration for the opportunity to participate in a Uniquely Tours tour or experience, you represent and warrant that: (i) the information supplied by you is true and correct,(ii) you are of sufficient age and mind to book, use our services, and create binding legal obligations, and (iii) you are legally authorized to act on behalf of those you represent and can accept these Terms and Conditions on their behalf. Please be aware that these Terms and Conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all of the Terms and Conditions laid out herein and acknowledging that you have read the terms and agree with them. 

 

By making a booking with us, you agree to these Terms and Conditions on behalf of you and all individuals included in your booking. You assume the responsibility of sharing these Terms and Conditions with each tour participant and solely bear the responsibility of making all payments when due. In the case the booking is made by a travel agent, or any other third-party entity (“third party”), the third party is responsible to provide all tour participants with a copy of our Terms and Conditions. It is the responsibility of each tour participant to read our Terms and Conditions in their entirety. 

 

The services to be provided are those in your booking confirmation. No alterations or variations to these Terms and Conditions are effective unless made in writing by and under the authority of Uniquely Tours. You agree to be bound by the Terms and Conditions that are in effect at the time of your tour or cancellation, whichever applies. You agree that it is your responsibility to be familiar with these Terms and Conditions and to check back from time to time for any changes. 

 

2. Advance Waiver of Liability And Assumption of Risk 

 

You acknowledge that you are voluntarily participating in this tour. You acknowledge that you are aware of the inherent risks associated with traveling to and from and participating in this tour, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. You acknowledge that you understand that these injuries or outcomes may arise from your own or other’s actions, inaction, or negligence. Such inherent risks include, but are not limited to, risk of injury or death from motor vehicle collisions, animals, roadway hazards, uneven terrain, loose or falling rocks, slips and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other participants, Uniquely Tours and its owners, employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or other animals; fatigue, chill, overheating, and/or dizziness; exposure to and death or illness resulting from certain viruses and bacteria including, but not limited to, the COVID-19 virus; known or unknown medical conditions; physical exertion for which you are not prepared for or other such accidents and incidents; accident or illness without access to rapid evacuation or availability of medical supplies and services; negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; the adequacy of medical attention, once provided. You further understand and acknowledge that the degree and nature of personal risk involved depends on the tour booked, the location in which the tour operates, and your overall health. 

 

You understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. To partake of the enjoyment and excitement of the tour, you are willing to accept the risks and uncertainty involved as being a part of travel, including the risks of infection, illness, injury, and even death. On behalf of you and your next of kin, heirs, and representatives, you hereby assume full responsibility for any and all risks and agree to and shall hold harmless and fully release from all liability and all claims associated with Uniquely Tours & Experiences, LLC dba Uniquely Tours, including each of their employees, officers, directors, volunteers, and agents (collectively “Released Parties”). You hereby covenant not to sue Released Parties for any and all claims, including claims of the Released Parties’ negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss suffered because of your participation in your tour, including travel to, from and during the tour, and your and other tourists’ use of alcohol during the tour. This Waiver of Liability and Express Assumption of Risk is written to be as broad and inclusive as legally permitted by the State of Texas. 

 

3. Indemnification 

 

You agree to and shall indemnify and hold harmless Uniquely Tours & Experiences, LLC dba Uniquely Tours, and each of our officers, directors, employees and agents (collectively “Uniquely Tours representatives”), from any expenses, losses, liabilities (of any type), damages, judgments, demands, settlements and costs (collectively, “damages”) involved with or incurred by Uniquely Tours (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) your breach or violation, or threatened breach or violation of this Agreement; (ii) Any damage caused by you or anyone you are responsible for or anyone listed on your booking while participating in the tour; (iii) your violation of any law or the rights of a third party; and (iv) your use of www.uniquelytours.com website or any affiliate websites. 

 

4. No liability for Acts or Omissions of Third Parties 

 

Uniquely Tours coordinates with various service providers and companies to create walking tours. Examples include transportation companies, tour guides, restaurants, admission ticket vendors, and other service providers and vendors. The persons or companies engaged in conducting those services are not employees or agents of Uniquely Tours. All such persons and entities are independent contractors. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each service provider, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that Uniquely Tours assumes no responsibility or liability for any change in schedule, loss, accident, property damage or loss, delay, inconvenience, expense or injury to you or any persons traveling with you owing to any act or default or negligence caused by any person or company engaged in providing those services. You agree that if a service provider causes damage or loss to you, that such service provider is solely responsible for compensation and you waive all rights, causes or action and claims for indemnity against Uniquely Tours. You agree to hold harmless Uniquely Tours from liability caused by any act or omission of yourself or any employee, member, guest, invitee, or of any third party of yourself, or arising from the use of any facility, equipment, transportation, or other instrumentation used or provided to you. Uniquely Tours reserves the right to refuse any traveler or potential traveler at its sole discretion. 

5. Pricing 

 

Pricing for Guided Tours 

The prices appearing on the website are the current rates and can change without notice. Once a traveler has booked a Uniquely Tours tour, the traveler will not be required to pay any difference in the event of a price increase. Uniquely Tours will not refund the balance of any price reduction. Our child rates apply at the time of the tour, not the time of booking. Proof of age must be available for inspection on the day of travel. If a traveler is identified as not qualifying for a child price (if a child price is available for the tour), the traveler will be required to provide the balance of difference between the adult rate and child rate for the tour before being permitted to start the tour. 

 

Per person 

All prices listed are on a per traveler basis unless otherwise stated. 

 

Inclusions 

Prices include only the items indicated on the tour description on www.uniquelytours.com or the booking page used by Uniquely Tours.

 

Exclusions 

Prices do not include: 

 

Tips and gratuities. If you are happy with the services provided by your guide, a tip — though not compulsory — is appropriate. While it may not be customary to you, it is of great significance to the people who will take care of you during your travels, inspires excellent service, and is an entrenched feature of the tourism industry across the United States. Please consider this when budgeting for your extra expenses on your tour. 

 

Items of a personal nature. These items include, but are not limited to snacks, meals, and drinks not specifically indicated in the inclusions section of the tour description. 

 

6. Payment 

 

Credit Cards 

Uniquely Tours accepts the following credit cards for payment: Visa; Mastercard; and American Express. While we do accept major credit cards, you must provide a click and/or signed authorization for every payment. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause (excepting fraud), including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions. In the event you attempt to chargeback, reverse, or recollect a booking payment already made without the authorization of Uniquely Tours, we reserve the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection, including, without limitation, attorneys’ fees. Travel Agents assume full financial responsibility for any chargebacks initiated by their clients with full payment due to Uniquely Tours within 10 business days of receipt of the invoice requesting payment. 

 

Payment Due 

With the exception of private tours, full payment is required at the time of booking. Payment for private tours is due as outlined in the invoice. upon. Payment for self-guided tours is in accordance with the terms indicated under the tour description on www.uniquelytours.com

 

7. Cancellations/no-shows and amendments to bookings 

Cancellation fees. Cancellation fees may apply to any cancellations by the traveler of a service provided by Uniquely Tours. Unless otherwise specified, the cancellation policy is as follows: 

  • Cancellations made more than 48 hours prior to travel receive a full refund.

  • Cancellations made 48 hours or less prior to travel require the traveler to pay for the tour in full, and no refund will be issued.

  • Cancellations on private tours are subject to the terms and conditions stated on the deposit invoice. 

 

Unused Portions of Tours 

No refund is provided for any unused portion of a tour, including the entire tour in the event a traveler does not commence at the designated starting point of the tour. 

 

Cancellations by Uniquely Tours 

We may cancel a tour at any time prior to departure. If we cancel your tour for any reason other than a “force majeure” event, you can transfer amounts paid to an alternate departure date or, alternatively, receive a full refund. In the event your booking is cancelled, we are not responsible for any expenses you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance, transportation costs, lodging costs, fees, and taxes. 

 

8. Force Majeure 

Uniquely Tours may be forced to delay or cancel a tour in whole or in part where circumstances amounting to ‘force majeure’ arise. In this situation Uniquely Tours will not make any refunds or pay any compensation or be responsible for any costs or expenses incurred by you as a result and our cancellation terms above will apply. ‘Force majeure’ means any event or circumstances which we or the supplier of the services could not foresee or avoid. Such events and circumstances include, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts or threats of terrorism or war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of similar nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, technical or maintenance problems with transport, changes of schedules or operational decisions of air carriers, nuclear activity, physical injury, medical or customs or immigration regulation, permit or authorization, damages to facilities for any tour or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Uniquely Tours that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. 

 

9. Amendments 

While we endeavor to operate all tours as described, we reserve the right to change the tour itinerary. The itinerary provided for each tour is representative of the activities planned; however, the route, amenities, stops, and modes of transport may be subject to change without prior notice due to local circumstances or events. If we make a major change before departure, we will inform you as soon as reasonably possible. We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. Such changes will not be considered as material, and no refund will be available. 

 

10. Confirmation and Vouchers Confirmation 

Upon receipt of full payment, you will receive a voucher via email for the booked tour. Voucher The lead traveler must present the original voucher issued by Uniquely Tours or the booking entity at the start of the tour. Uniquely Tours reserves the right to refuse service to any traveler not able to provide their voucher to their guide at the beginning of the tour. 

 

11. Your Uniquely Tours Tour Timeliness 

Travelers must adhere to the start time set out in the product information on their voucher. In the event a traveler is not at the designated starting point within 15 minutes of the start time provided, Uniquely Tours will consider the traveler to be a “no show” and the tour will start without them and no refund will be provided. It is recommended that you arrive at least 10 minutes prior to the start of the tour. Your responsibility The traveler making the booking is responsible for their own and their party’s actions. If Uniquely Tours deems you or your party’s actions to cause danger to other travelers or our staff, to intervene with other clients’ enjoyment of the trip, or to be offensive to the local communities and cultures, Uniquely Tours reserves the right to remove you from the tour effectively immediately. No refund will be provided. you must at all times comply with the laws and customs of all places visited. Dogs are not permitted on our tours, with exception for some private tours and service dogs, as defined by the Federal Americans with Disabilities Act. If you bring a dog on a private tour or bring your service dog, you are solely responsible for the conduct of your dog. If your dog Is disruptive or becomes a physical threat to others, we will ask you to leave the tour, and no refund will be given. Rain or Shine All scheduled tours will operate rain or shine unless the service provider cancels the main attraction of a tour, or extreme weather prevents us from performing the tour safely which requires us to cancel the tour. In either case you will be notified as soon as possible, with an offer to reschedule and transfer your booking, receive a full refund, or credit. 

 

12. Age and Health Requirements 

Age Requirements All travelers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveler under the age of 18. Please see the tour description on www.uniquelytours.com to check whether a tour is child friendly. For tours featuring alcohol, travelers may be required to show proof of age of majority. Health Requirements Some of our trips can be physically demanding and travelers must ensure that they are suitably fit to allow participation. Most tours involve walking, step-climbing or other physical activities during the course of the tour, and travelers should be in good mental and physical health to fully participate. Travelers are responsible for making a determination of the appropriateness of a tour in consideration of their personal limitations prior to making a reservation. We are able to provide details on mandatory health requirements; however, we are not medical experts. All our tours specify a physical rating, which is to be used as a guideline for gauging whether a tour is appropriate for your fitness level. For the safety of our guests, we reserve the right to request health information prior to the tour and to exclude any traveler we deem unfit for the tour at our sole discretion. 

 

13. Persons with Disabilities 

Uniquely Tours is happy to make reasonable accommodations to our disabled guests with adequate advance notice. It is essential that you advise us before booking if you have any disability or pre-existing condition that may affect your participation on the tour, or if you have any special requirements as a result of a disability or medical condition (including any which may affect the booking process) so that we can assist you in considering the suitability of our arrangements and/or in making the booking. While on tour we are unable to provide personalized assistance; therefore, persons with special needs should be accompanied by an individual who will take full responsibility for any personalized assistance needs during the tour and in the event of an emergency. 

 

14. Travel Insurance 

Uniquely Tours cannot be held responsible for any liability, expenses, or losses you incur as a result of being inadequately insured. We strongly recommend that at the time of booking a comprehensive travel insurance policy is purchased. Such plan at a minimum should cover Trip Cancellation or Interruption, Cancel for Any Reason, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. We are not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. We cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker. Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available. 

 

15. Complaints & Notice of Claim 

Should you have a complaint about your tour experience, we urge you to promptly notify Uniquely Tours or your tour guide so the matter can be resolved if possible. If satisfaction is not reached through this notice procedure during your tour, you must submit further claims in writing to Uniquely Tours within 30 days of travel before filing any form of lawsuit or dispute. You understand and agree that no claims will be considered and that you will not bring suit against Uniquely Tours unless you have first provided a typewritten notice of claim to Uniquely Tours within thirty (30) days after the tour or cancellation of the tour. Claims received outside this timeframe will not be considered and shall be considered waived and barred. 

 

16. Photos and Marketing 

You consent to us using images of you taken during the tour for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes. 

 

17. Privacy Policy 

By visiting www.uniquelytours.com, providing any information to us, and/or by booking with us you agree to our Privacy Policy. Our Privacy Policy is available on our website. 

 

18. Disclaimers 

Uniquely Tours maintains information that is accurate to the best of our knowledge; however, does not warrant that content and information provided on www.uniquelytours.com or via any of our affiliate sites or via distributors will be without error and that functionality of the websites uninterrupted or without error. We reserve the right to correct any errors, including errors in pricing. 

 

19. Jurisdiction and Choice of Law 

This agreement is governed by the laws of the State of Texas and that any disputes arising out of this agreement will be heard in a court of competent jurisdiction in Travis County in the State of Texas and be determined under Texas law without regard to conflict of law principles. 

 

20. Class Action Waiver 

You agree that you will only bring claims against Uniquely Tours in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. Uniquely Tours shall not in any case be liable for other than compensatory damages, and your payment on a tour means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Uniquely Tours unless you have first provided a written notice of claim to Uniquely Tours within 30 days after the tour or cancellation of the tour. 

 

21. Liquidated Damages 

You agree that any damages you may incur as a result of any breach of this Agreement will be extremely difficult to determine at the time of booking. Therefore, you acknowledge and agree that any damages resulting from a breach of this Agreement by Uniquely Tours should be limited to the amount you paid to Uniquely Tours for the tour applicable to the occurrence of the breach. You shall not be entitled to any other damages resulting from the breach. 

 

22. Entire Agreement & Severability 

This Agreement, including any other documents or invoices we provide you, constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Uniquely Tours. In the event that any provision contained here is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining Terms and Conditions to survive and continue as binding. 

 

23. Updating of Terms and Conditions 

Uniquely Tours reserves the right, in our sole discretion to update and/or alter these Terms and Conditions at any time. The latest Terms and Conditions can always be found on the Uniquely Tours website, www.uniquelytours.com and will supersede any previous versions. The date of the last updated version will be indicated at the top of this Agreement. Your continued use of our services, including continuing to maintain your booking after any changes to the Terms and Conditions constitutes your consent to the changes.
